By these pictures Link does this look like a trac-lok third member? I have my differential out and apart and it is supposed to be an Open 3.0 but looking at these pictures it looks exactly the same. Wouldn't a open and a trac-lok third member look different?

From my understanding, that is a trac-lok unit since it would take a socket to remove the bolts for the ring gear. Bolts on an open unit can be removed with a wrench.

The spot faced bolt recesses are the dead giveaway of a traction lok unit. The open carrier has a totally flat machined surface...

The one in the link is definately a traction-lok. Here's a pic of a 9" open. Notice the bolts holding the 2 halves of the carrier and how, like the others have said, they are not recessed and you could easily put a box end wrench on them.
